FlyersRights.org President Paul Hudson appeared on CBS Evening News on September 13, 2017 to discuss the July 28 judicial victory in the Federal Court of Appeals for the D.C. Circuit. The three judge panel ordered the FAA to re-consider its decision to not place a moratorium on further seat size reductions. The FAA relied on evacuation studies that were either outdated, irrelevant to the issue before the court, or were deemed proprietary and not released.
Recently, the Daily Beast has reported that the FAA has conducted crash tests at these smaller seat pitch sizes (although we still can’t know whether the FAA has conducted emergency evacuation tests at these pitches). The results reportedly show that passengers are unable to assume the brace position, and as a result, the dummies have shattered the TV screens on the seat back in front of them.
